The enigma of counterfeiting has been in existence and growing for quite some time.
In simple words “counterfeiting” refers to an act of creating or manufacturing products to look similar to the original, with the intention to trade in an illegal or dishonest manner. Reports prove that counterfeit acts affect the global economy as a whole and also contribute to unemployment .
In India, the law governing Intellectual Property Rights deals with such fraudulent activities of counterfeiting as it directly invokes the Intellectual Property Rights of the aggrieved.
Counterfeit has become a global issue and can only be tackled to an extent by the right holder by keeping a close watch in the market space so as to enforce his right if any fraud activities are discovered.
